Uvah Care is a “Company” providing services related to Health and Wellness by the brand name Uvah Care. These Terms of Service constitute a legally binding agreement between you and Uvah Care (together with its affiliates, “Uvah Care”, “we,” “our” or “us”) governing your use of the Uvah Care Service (as defined below), our mobile application (the “App”) and our website (the “Site”). The related services provided by Uvah Care to potential Client (defined in Section 1), the Site, and the App are collectively referred to as the “Service.” YOU ACKNOWLEDGE AND AGREE THAT, BY CLICKING ON THE “I AGREE” OR SIMILAR BUTTON, REGISTERING FOR AN ACCOUNT, DOWNLOADING THE APP OR ANY APP UPGRADES, USING THE APP ON YOUR MOBILE DEVICE, OR ACCESSING OR USING THE Uvah Care PLATFORM, YOU ARE INDICATING THAT YOU HAVE READ, UNDERSTAND AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE, WHETHER OR NOT YOU HAVE REGISTERED WITH THE SITE OR THE APP. IF YOU DO NOT AGREE TO THESE TERMS OF SERVICE, THEN YOU HAVE NO RIGHT TO ACCESS OR USE THE Uvah Care PLATFORM. These Terms are effective as of the date you first click “I agree” (or similar button or checkbox) or use or access the Platform, whichever is earlier. Any personal data you submit to the Uvah Care Platform or which we collect about you is governed by our Privacy Policy (“Privacy Policy”), available at https://www.Uvah Care.com/privacy. You acknowledge that by using the Uvah Care Platform you have reviewed the Privacy Policy. The Privacy Policy is incorporated by reference into these Terms of Service and together form and are hereinafter referred to as this “Agreement.”

Service
The Uvah Care Service includes web and mobile application-based personal training service. “Clients” are individuals who subscribe to Uvah Care’s fitness classes, meditation, nutrition and related services (the “Services”) from Uvah Care. Clients are hereinafter referred to as “Users.”

Changes to Terms
The Company shall have the right, at its sole discretion, to modify, add, or remove any terms or conditions of these Terms of Service without notice or liability to the User. Any changes to these Terms of Service shall be effective immediately following the posting of such changes. The User agrees to review these Terms of Service from time to time and agree that any subsequent use by the User of the Services following changes to these Terms of Service shall constitute the User’s acceptance of all such changes.

Cookies
Uvah Care uses cookies and similar tracking technologies to track the activity on our Services and hold certain information. Uvah Care may set and access Uvah Care Cookies on your computer. Uvah Care may allow other companies/entities that are presenting advertisements on Uvah Care's web pages or other publishers' web pages to set and access their respective Cookies on your computer. Other companies' use of their cookies is subject to their own privacy policies, not this one. Advertisers or other companies do not have access to the Cookies of Uvah Care Your Ability to Edit and Delete Your Account Information and Preferences Uvah Care gives you the ability to edit the information that is logged in when you register on Uvah Care's Website, and preferences at any time, including whether you want Uvah Care to contact you about offers etc., and any new Services that it lists on its Website in the future.

Access and Use of Service
Users registering for the Services must be at least eighteen (18) years of age. In case the User is below 18 years of age, the User Registration information must be verified by the parents/guardians. The Company makes no claims that the Services may be lawfully accessed in any specific location. Access to the Services may not be legal by certain persons or in certain states or certain countries, or may require government authorization or registration. When the Users access the Services, they are solely responsible for compliance with the laws and regulations of their jurisdiction.

Usage Data
Uvah Care may also collect information that your browser sends whenever you visit our Website or when you access the Services by or through a mobile device ("Usage Data"). This Usage Data may include information such as your computer's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Services that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data. When you access the Services by or through a mobile device, this Usage Data may include information such as the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data.

User's Conduct
The Services may be used only for lawful purposes relating to live and/or offline streaming and related materials. The Company specifically prohibits any use of the Services, and all Users agree not to use the Services, for any purposes other than designated by the Company. The User is prohibited from violating or attempting to violate the security of the Services, including, without limitation, (a) accessing data not intended for such user or logging into a server or account which the user is not authorized to access, (b) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization, (c) attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus to this Services, overloading, "flooding", "spamming", "mail-bombing" or "crashing", (d) forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting, (e) scraping or harvesting data or (f) the use of robots to skew payouts. Violations of system or network security or inappropriate conduct may result in civil or criminal liability. The Company will investigate occurrences that may involve such violations and may involve, and cooperate with law enforcement entities in prosecuting users who are involved in such violations.

User Information
The User is solely responsible for the information s/he inputs or uploads to the Services and warrants and represents that the User has the right and authorization to register for the Services and post User Generated Content. The Company reserves the right in its sole discretion to decide whether the information User inputs or uploads is appropriate and complies with the Terms of Service, other Company policies, and applicable laws and regulations. If the User registers for the Services, s/he will be asked to provide certain information including a valid email address. The User warrants and represents that all such information is current and accurate, and will be kept up-to-date. The User’s privacy rights are set forth in Company’s Privacy Policy. Company reserves the right to offer Company or third party services and products to the User based on the preferences that the User identifies in his/her registration and at any time thereafter, unless the user opts-out of receiving third party services and products.

Medical Disclaimer
Before starting any yoga or other exercise program through the Service, the User may consult his/her physician to determine if such program is right for the User’s needs. Company is not a medical organization and its teachers or staff cannot give the user any medical advice or diagnosis. All suggestions and comments relating to the use of equipment, poses, moves and instruction are not required to be performed by the user and are carried out at the user’s election while using the Service. Nothing contained in this Service should be construed as any form of such medical advice or diagnosis. By using the Services, the User represents that s/he understands that physical exercise involves strenuous physical movement, and that such activity carries the risk of injury whether physical or mental. The User understands that it is his/her responsibility to judge his/ her physical and mental capabilities for such activities. It is the User’s responsibility to ensure that by participating in classes and activities from the Company, s/he will not exceed his/ her limits while performing such activity, and s/he will select the appropriate level of classes for his/ her skills and abilities, as well as for any mental or physical conditions and/or limitations the user has. The User understands that, from time to time the trainers may suggest physical adjustments or the use of equipment and it is the User’s sole responsibility to determine if any such suggested adjustment or equipment is appropriate for his/ her level of ability and physical and mental condition. The User expressly waives and releases any claim that the User may have at any time for injury of any kind against Company, or any person or entity involved with the Company, including without limitation its directors, trainers, independent contractors, employees, agents, contractors, affiliates and representatives. Each User is solely responsible for deciding whether the Services offered are suitable for his/ her own purposes and whether the Services match the User’s needs. The Company grants the User a limited, non-exclusive license to access and use the Services for the User’s own personal and non-commercial purposes. This includes rights to view content on the Company's website and applications. If the User elects to access any component of the Services for which there is a fee, the User agrees to pay all fees and charges associated with his/ her account on a timely basis. All such fees and charges (including any taxes and late fees, as applicable) will be charged on the User’s payment mode. Each User agrees to maintain valid payment information as part of the User’s account information when applicable.
